ENSP Questionnaire Tobacco Products Directive 2014/40/EU and Tobacco Advertising Directive (2003/33/EC)
In order to prepare a brief shadow report on the Application of the Directive 2014/40/EU and and Tobacco Advertising Directive (2003/33/EC) ENSP is kindly asking you to answer to the following questions:

required 2) 20 May 2016 was the Tobacco Products Directive transposition deadline for Member States. Did your country meet this deadline?



required 3) 1. Packaging and labeling -- The Tobacco Products Directive (2014/40/EU) requires cigarettes, roll-your-own tobacco and waterpipe tobacco to carry combined health warnings consisting of a picture from the EU picture library, a text warning and information on stop smoking services. EU countries may also choose to apply the same requirements to other tobacco products such as cigars, cigarillos and pipe tobacco. The warnings should cover 65% of the front and back of packages. Tobacco products with combined health warnings must also carry a general warning and information message. What type of tobacco packaging is your country implementing?



required 4) 2. Ingredients and emissions -- A. Providing information on tobacco products, e-cigarettes and refill containers - The EU Common Entry Gate (EU-CEG) Under the Tobacco Products Directive (2014/40/EU), manufacturers and importers of tobacco products, e-cigarettes and refill containers have to submit key information to the authorities in the Member States in which they plan to market the products. This includes information on: • ingredients • emissions • toxological data. The IT tool for providing this information is called the EU Common Entry Gate (EU-CEG). Is this system operational in your country?



required 5) In some EU countries, EU-CEG can be used to provide information on other products, such as: • novel tobacco products • herbal smoking products • nicotine-free e-cigarettes. Is EU-CEG used in your country for collecting information on other products?



required 6) B. Determination of characterising flavours in tobacco products The Tobacco Products Directive (2014/40/EU) prohibits the placing on the market of cigarettes and roll-your-own tobacco with a characterising flavour. In order to facilitate the implementation of this provision, set out in Article 7 of the Directive, the Commission has adopted two implementing acts establishing the rules and mechanism for determining products with characterising flavours: Is this provision implemented your country?

Electronic cigarettes -- Article 20 of the Tobacco Products Directive (2014/40/EU) lays down rules for electronic cigarettes sold as consumer products in the EU. / Safety and quality requirements for e-cigarettes / The Directive sets a maximum nicotine concentration and volume for cartridges, tanks and nicotine liquid containers. E-cigarettes should be child-resistant and tamper evident and have a mechanism that allows refilling without spillage to protect consumers. E-cigarette ingredients must be of high purity and e-cigarettes should deliver the same amount of nicotine when puffed at the same strength and duration. Manufacturers and importers must notify all products they place on the EU market through a standardised electronic format. // Packaging and labelling rules for e-cigarettes // Health warnings for e-cigarettes advising consumers that they contain nicotine and should not be used by non-smokers are mandatory. Packaging must also include a list of ingredients contained in the product, information on the product's nicotine content, and a leaflet with instructions for use and information on adverse effects, risk groups, addictiveness and toxicity. Promotional elements are not allowed on e-cigarette packaging, and cross-border advertising and promotion of e-cigarettes is prohibited. Monitoring and reporting of developments related to e-cigarettes The Directive lays down monitoring and reporting requirements for manufacturers and importers, EU countries and the Commission. // Are all these rules enforced in your country?

Fighting illicit trade in tobacco products -- Articles 15 and 16 of the Tobacco Products Directive 2014/40/EU (TPD) provide for EU-wide systems of traceability and security features for tobacco products to address the issue of illicit trade. The systems became operational on 20 May 2019. Is this system operational in your country?

Final question on Tobacco Products Directive 2014/40/EU -- In your opinion, please indicate those parts of the Tobacco Products Directive 2014/40/EU that should be reviewed or adapted taking into account new scientific and technical developments as well as internationally agreed rules and standards:

Advertisement and sponsorship -- Tobacco advertising and sponsorship is restricted in the EU by the: • Tobacco Advertising Directive (2003/33/EC) • Audio-visual Media Services Directive (2010/13/EU) • Council Recommendation (2003/54/EC) on the prevention of smoking and on initiatives to improve tobacco control The Tobacco Advertising Directive (2003/33/EC) introduces an EU wide ban on cross-border tobacco advertising and sponsorship in the media other than television. The ban covers print media, radio, internet and sponsorship of events involving several EU countries, such as the Olympic Games and Formula One races. Free distribution of tobacco is banned in such events. The ban covers advertising and sponsorship with the aim of direct or indirect effect of promoting a tobacco product.
